  3. Access to the Service.
    • The Company offers a service of providing digital entertainment content to users of compatible devices under a subscription model and payment by debit from the mobile phone bill.
    • RTST.Ai is a Ai based tool allowing the subscribers to convert simple looking text to Ai generated images. (hereinafter, the "Service(s)").
    • Once the subscription process to the Service is completed, the user will benefit from unlimited access through the Portal to all digital content offered by the Company, which may be periodically updated at its discretion.
    • The subscription amount will be reported on the bill of the mobile operator with which the subscriber is under contract, in post-payment or pre-payment.
    • To access the Service, an internet connection is required, which may result in an additional cost depending on the rate agreed with the mobile operator. In addition, it is essential to have a compatible device and updated software to connect to the Service. Compatibility can be checked in point 7.
    • The User may download the terms of this Agreement on a durable medium in digital or printed format. In any case, the terms are public and permanently accessible on the Portal.

  4. User and Subscriber Conditions.
    • The User is the person who accesses, navigates or uses the Portal, or accesses the Service with the consent of the Subscriber. The User may be the same person as the Subscriber or a different person.
    • The subscriber to the Service is the owner of the line and telephone number with a postpaid or prepaid contract in force with a mobile operator. The subscriber may be the same person as the user or a different person.

  5. Rates.
    • The rates for the Service, including VAT, vary depending on the mobile operator: Bouygues: 2.99 EUR per week; Coriolis: 2.99 EUR per week; Orange: 2.99 EUR per week; SFR: 2.99 EUR per week.

  6. Specific conditions of mobile operators.

      - Orange operator.
    • The Service is a subscription service at the price of Orange: 2.99 EUR per week, with automatic renewal. Once subscribed, the user has unlimited access to all the contents of the Portal.
    • Depending on the content, the Subscriber can enjoy it by downloading the content to their device or by streaming.
    • For the user who accesses the Portal via a 3G connection from his mobile phone:
      The user must validate a first step that will lead him to the creation of an account. After completing the various fields and validating them, he will receive an SMS containing a PIN code. Once the PIN code is entered and the payment confirmed, the subscription process will be finalized and the user will be able to enjoy the service.
    • For the user who accesses the Portal via a Wifi connection:
      The user must validate a first step that will lead him to the creation of an account. After completing the various fields and validating them, he will receive an SMS with a PIN code. Once the PIN code is entered and the payment confirmed, the subscription process will be finalized and the user will be able to enjoy the service.

    • Unsubscribe procedure:
    • The Subscriber may unsubscribe and terminate the contract at any time, without justification, by following one of the procedures indicated below. Once the unsubscription has been carried out, the use of the contracted service and its billing will be interrupted.

    • This Portal is a subscription service at the price of SFR: 2.99 EUR per week, with automatic renewal. Once the user has subscribed, he will have unlimited access to all digital content on the portal. The Customer has registered via Internet+ Mobile access.
    • For the user who accesses the Portal via a 3G connection from his mobile phone:
      The user must first validate a first step that will take him to a payment confirmation page. After validating this second step, the subscription process will be finalized and the user will be able to enjoy the service.
    • For the user who accesses the Portal via a Wifi connection:
      The user must complete and validate a first step with his mobile phone number. In a second step, he must fill in the field with the PIN received by SMS and validate it. The subscription process will be finalized and the user will be able to enjoy the service.

    • Unsubscribe procedure:
    • The Subscriber may unsubscribe at any time and without justification by following one of the procedures indicated below. Once the unsubscription has been carried out, the use of the contracted service and its billing will be interrupted.

    • The user accesses the Portal via a 3G connection from his mobile phone:
      The user must validate a first step that will take him to the payment confirmation page. After validating this second step, the user will have to complete the account creation to finalize the subscription process and be able to enjoy the service.

    • Unsubscribe procedure:
    • The Subscriber may unsubscribe at any time and without justification by following one of the procedures indicated below. Once the unsubscription has been carried out, the use of the contracted service and its billing will be interrupted.
    • To request unsubscription from the Services, you may follow one of the following steps:

    • For the user who accesses the Portal via a 3G connection from his mobile phone:
      The user must first validate a first step that will take him to a payment confirmation page. After validating this second step, the subscription process will be finalized and the user will be able to enjoy the service.
    • For the user who accesses the Portal via a Wifi connection:

    • - Free trial.
    • When subscribing to your subscription to the Service, and when available, you may benefit from a free trial during the period as described in the Services offer. Your first payment will be taken immediately after the free trial, unless you cancel your subscription in accordance with the cancellation instructions provided in the T&Cs. You also have the option to cancel your subscription at any time before the end of the free trial.

  7. Compatibility of Services.
    • Please check below if the offered contents are compatible with your PC or device.
    • Compatible with Mac, PC, tablets and smartphones that use one of the following browsers: Firefox, Safari, Chrome.
    • Important! Some digital content on this Service is not compatible with Windows Phone, Internet Explorer, iPhone versions prior to iPhone 5, and Android versions prior to 4.4.

  8. Notification Service.
    • The Portal has a free communication tool that consists of sending notifications to devices.
    • This tool can be canceled at any time via the “Website Settings” link available in the notification message itself or via the configuration menu that appears in the device settings.

  9. Right of withdrawal and refund policy.
    • The subscriber is expressly informed that he has a withdrawal period of 14 days from the subscription to the Service.
    • To make this right effective, the subscriber must inform the Company within the said period; he can use the attached withdrawal form or any other means for this purpose.
    • Once informed, the Company will reimburse the sums paid by the subscriber within a maximum period of 14 days.
    • At the end of the period for exercising the right of withdrawal, Customer Service will study each specific case based on the circumstances that are the subject of the complaint. In these cases, the user and/or subscriber will also be informed of the refund policy applicable by the mobile operator in force at any time.

  10. Guarantee of conformity.
    • The Service benefits from the guarantee of conformity for the entire duration of the subscription.
    • The legal warranty coverage refers to the following aspects related to the provision of the service:
      - Adhere to the description, type of goods, quantity and quality and have the functionality, compatibility, interoperability and other characteristics of the service and those established in this contract.
      - Be suitable for the purposes for which digital goods or content or services of the same type are usually intended and for the specific purposes required by the consumer and for which the entrepreneur has acknowledged said use.
      - Present the quality and qualities and other characteristics, in particular with regard to the durability of the good, the accessibility and continuity of the content or digital service that goods of the same type usually present and that the consumer or user can reasonably expect.
    • The subscriber may execute this guarantee by contacting our Customer Service, the contact details of which are detailed in point 14.

  11. Responsibility of the User and/or Subscriber.
    • The User and/or Subscriber may not use the Service for commercial purposes or for purposes other than those defined in this contract.

    • - Respect for the intellectual, industrial and/or similar property rights of third parties.
    • In general, and for all Services, the User and/or Subscriber undertake to respect and comply with the regulations applicable in the context of the use of the Service. In particular, they must respect intellectual and industrial property rights, including trademarks and other distinctive signs of third parties, as well as the image rights of third parties.
    • Users and/or Subscribers must only use content that they own, unless they are authorized to use third-party content. In other words, they must not use content such as photos, videos, etc. that they have not created themselves or that contain images for which they do not have the corresponding authorization, nor use content whose rights belong to another person if they do not have the express authorization that may be required by the Company at any time.

    • - Use of Artificial Intelligence tools.
    • For the provision of the Services, the Company has developed various AI tools using third-party software and grants their use to the User and/or Subscriber. The use of the Services and the generation of content are the responsibility of the User and/or Subscriber.
    • The Subscriber guarantees that the use of the Service will not infringe the rights of third parties and undertakes in particular to protect the right to honor, to personal and family privacy and to his own image, any activity or dissemination of content infringing these rights of third parties being expressly prohibited.
    • Furthermore, it is expressly prohibited to generate and disseminate information and content that is discriminatory on the grounds of birth, race, gender, religion, opinion or any other social condition; to disseminate inappropriate content such as images or videos of a sexual nature, violent content, inappropriate language, fashions that encourage negative values that may lead to health risks or bad habits, or false or lacking rigor, slanderous or defamatory information, especially with regard to minors.
    • In this sense, the user and/or subscriber are warned by the Company that access to content moved by minors may have multiple consequences according to studies by the National Commission for Information Technology and Civil Liberties. Without being exhaustive, these consequences may be the following: - Psychological and emotional damage. - Misinformation, manipulation and construction of false beliefs. - Implementation of dangerous or socially inappropriate behaviors. - Damage to physical health. - Inclusion in harmful groups and collectives. - Addictions. - Economic costs.
    • The User and/or Subscriber are solely responsible for the consequences of illegal, unauthorized or inappropriate use of digital content.
    • The User and/or Subscriber expressly authorize the Company, with regard to the subscribed Service, to provide any information and documentation required by the administrative, police and/or judicial authorities.

    • - Civil majority
    • The Subscriber must be of legal age to subscribe to the Services. The owner of the telephone line through which the subscription was taken out will always be responsible for paying for the corresponding service. In addition, the Subscriber must ensure that the user of the service, if a minor, has his express authorization.

  12. Suspension of Users’ and/or Subscribers’ accounts.
    • The Company may suspend, as a precautionary measure, the account of users and/or subscribers who do not comply with these conditions. Furthermore, the Company reserves the right to terminate the contractual relationship in the event of a violation of these conditions by the user.

  13. Liability of the Company.
    • The Company is responsible for providing the services under the conditions set out above. Liability arising from unforeseeable circumstances and/or force majeure is excluded.
    • The Company is not liable for any loss or damage suffered by the User and/or Subscriber which is directly or indirectly attributable to the User's failure to comply with his obligations under this contract.
    • In accordance with the provisions of our legal system, the Company's liability for damages will have an economic limit equivalent to the amount paid by the Subscriber for the Services subject to the contract.

  15. Jurisdiction and applicable legislation.
    • The Company, domiciled at Dubai, United Arab Emirates, without prejudice to the Jurisdiction that may legally correspond in each case. Controversies, disputes or claims will be governed and interpreted in accordance with Spanish legislation.
